Optometrist Referral Win-Win Program at Vision Expo West 2013 Terms and Conditions
If you are an optometrist attending Vision Expo West 2013, you have the opportunity to earn a prize by referring optometrists who are new to the Show (and your referrals who attend are also eligible for a prize!).
1. HOW TO PARTICIPATE:
(a) Online Submission Only. You may participate by referring up to five (5) optometrists via the online Optometrist Referral Program submission form available at www.visionexpowest.com/odreferral. Please note:
- Only referrals made through the Optometrist Referral Program online submission form will be eligible for this Program.
- The dates for eligibility in this program are from 12:00 AM EDT on April 20, 2013 through 11:59 PM EDT on September 26, 2013.
- You may submit more than one Optometrist Referral Program submission form, but the total number of referrals you make may not exceed five (5).
- We will review your referral submission form and confirm whether any of your referrals have attended Vision Expo West in the last three years. A referral who (i) has not attended Vision Expo West in the last three years and (ii) was first referred by you is an "Eligible Referral"). If an optometrist who has not attended Vision Expo West previously is referred by more than one Program participant, such optometrist will count as an Eligible Referral only for the Program participant whose submission form was received first.
- All submissions must be completed by 11:59 PM EDT on September 26, 2013.
(b) Earning a Prize. You will qualify for one prize if one (or more) of your Eligible Referrals registers for Vision Expo West 2013 by no later than 11:59 PM EDT on September 26, 2013 and actually attends Vision Expo West 2013. You will not be awarded more than one prize regardless of the number of your Eligible Referrals who register and attend Vision Expo West 2013.
(c) Prize Preference. If any of your Eligible Referrals register for Vision Expo West 2013 on or before September 26, 2013, you will be required to pre-select a prize preference by no later than 11:59 PM EDT on October 1, 2013. A Program representative, Jamie Jordan, will contact you before such time. Although your prize preference is binding, please note that you will not qualify for a prize unless and until your Eligible Referral(s) actually signs in onsite at Vision Expo West 2013.
2. PRIZE DETAILS:
(a) Subject to the Program's terms and conditions, each Program participant who qualifies for a prize may select one of the four prize options below:

(b) Pick Up Location. If you have qualified for a prize in accordance with the terms and conditions herein, you may pick up your pre-selected prize onsite at Vision Expo West 2013 at the Optometrist Referral Program Check-In desk in the Registration Area in the Sands Expo and Convention Center.
(c) Eligible Referrals Who Qualify For a Prize. Eligible Referrals who register for Vision Expo West 2013 by no later than 11:59 PM EDT on September 26, 2013 will be contacted by a Program coordinator, Jamie Jordan, to explain they will qualify for a prize if they attend Vision Expo West 2013. At such time, the Eligible Referral will be required to pre-select a prize preference. However, the Eligible Referral will not qualify for a prize unless and until he/she actually signs in onsite at Vision Expo West 2013. He/she may pick up their pre-selected prize onsite at Vision Expo West 2013 at the Optometrist Referral Program Check-In desk in the Registration Area at the Sands Expo & Convention Center.
(d) General. Prizes are nontransferable and no substitution will be allowed. Sponsors assume no responsibility or liability for damages, losses or injury resulting from acceptance or use of a prize.
3. ELIGIBILITY:
This Program is open to optometrists registered for Vision Expo West 2013 who are legal residents of the United States of America.
4. ONLINE SUBMISSION DISCLAIMER:
Sponsors are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the contest/sweepstakes, Sponsors reserve the right, in their sole discretion, to disqualify any individual who tampers with the submission process, and to cancel, terminate, modify or suspend the contest.
No responsibility is assumed for: any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, providers, computer equipment, or software; or failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from participation in or downloading any materials from this contest.
5. GOVERNING LAW:
The laws of the State of Nevada, without reference to the conflicts of laws provisions thereof, govern this Program and all aspects related thereto. Except where prohibited, each participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Program or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Las Vegas, NV; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; (3) no punitive, incidental, special, consequential, or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"); and (4) participant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased.
6. OTHER:
This Program is void where prohibited by law. Sponsors reserve the right to modify or terminate Program at any time. Should there be any tax liability for the prizes; such taxes are the sole responsibility of the participant. Sponsors' decisions are final on all matters relating to this Program.
